1.    Collection of certain Personal Data 

OPTIM SALON, a simplified joint stock company with a capital of 10.000 euros, registered in the Nanterre Trade and Companies Register under number 904 045 697, having its registered office located at 83 Rue Gambetta - 92150 Suresnes, France, whose intra-community VAT number is FR31904045697 and represented by its President, Mrs. France Burnand ("OPTIM SALON"), complies with all regulatory and legislative provisions relating to the protection of personal data (the "Applicable Regulations"), and in particular all of the provisions set out in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (the "General Data Protection Regulation" or "GDPR"), as well as the provisions of French Law no. 78-17 of 6 February 1978 as amended, known as the "Data Protection Act" (the "LIL"), and all other applicable regulation as the case may be.

OPTIM SALON organises meetings between professionals in the fields of intralogistics, freight transport, logistics and the supply chain (the "Events").

OPTIM SALON's services are presented on the OPTIM SALON site accessible at  https://optimsalon.com/ (the "Site"). The Client applies online using the form on the Site..

Clients, prospective clients, participants to the Events (as defined in the Terms), in view to their registration and participation to the Events, users of the Site and more generally all data subjects, acknowledge and accept that OPTIM SALON processes some of their personal data (the "Personal Data"), in accordance with the terms and conditions of this Policy relating to the protection and use of Personal Data (the "Privacy Policy" and alternatively the "Policy").

 “Personal Data" refers to any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity.

2.    General rules applicable to the collection and processing of personal data 

It is reminded that in accordance with the Applicable Regulations, Personal Data is:

3.     Nature of the collected Personal Data

3.1 The data controller is OPTIM SALON, which remains the sole recipient of the Personal Data concerned.

The Personal Data requested from Clients and all users is intended for the data controller. If the data subject fails to provide this data, his/her request cannot be processed.

For all intents and purposes, it is reminded that the data controller is, in accordance with the applicable legislation, the entity that defines and limits the data to be collected and the purposes for which it is processed.

In any event, this Personal Data is collected and processed on the basis of a legal obligation, a legitimate interest of OPTIM SALON and/or the consent of the data subject.

3.2 It is specified that online registration and the Client's registration for an Event is carried out via the site of the service provider designated by OPTIM SALON, WEB PERSPECTIVE, publisher and operator of the matchmaking-studio.com platform. WEB PERSPECTIVE acts in this context as a processor of OPTIM SALON, and OPTIM SALON has entered into all necessary agreements for this purpose in the context of the processing of the Personal Data of Clients and any other data subjects.

It is also reminded that the conditions of processing of Personal Data by WEB PERSPECTIVE if the latter intervenes as data controller directly are provided by WEB PERSPECTIVE. It is also remined, as specified in OPTIM SALON’s Terms, that the matchmaking-studio.com platform is a third-party platform and the conditions of use of this platform are defined by the operator of this platform. The Client is required to comply with the conditions of use of the said platform as issued by said platform and in force on the day of use of the platform.

3.3 The Personal Data which are collected are the following:

-       Profile - Registration 

All registrations require the following information:

        o   Name;

o   Email;

o   Telephone number (mobile and landline);

o   Position;

o   Company;

o   Sector of activity;

o   Target industries.

The Client is reminded that online registration and registration for an Event is carried out via the website of the service provider designated by OPTIM SALON as defined above. To this end, the Client receives a link redirecting them to the said platform following their request to participate made on the Site and/or sent to OPTIM SALON.

-       Provision of Services

 As part of the provision of the Services, OPTIM SALON collects information relating to participants in the Events. It is the Client's responsibility to provide and obtain all necessary authorisations and agreements for the provision of said information to OPTISALON. 

The information relating to participants to the Events is as follows:

        o   Name;

o   Professional email;

o   Telephone number;

o   Business address;

o   Invoice address;

o   Position within the company;

o   Company;

o   Sector of activity ;

o   Target industries.

 

In this context, the Client informs its participants and all data subjects of the processing of their Personal Data at the time of collection and, more generally, of the policy implemented by the Client relating to the processing of Personal Data, in compliance with the rules relating to the use of Personal Data, and in the context of the relationship between the Client and the said participant.

Clients shall inform the data subjects of the nature, means and purposes of the processing of the said Data. OPTIM SALON is not, in any event, a party to the relationship between the data subject and the Client.

 

-       Payment

 As part of the payment for the Services, OPTIM SALON and/or its designated service providers process financial data relating to the Client's bank account.

 It is specified that invoices for all orders are issued by OPTIM SALON. OPTIM SALON invoices are, unless otherwise agreed between the parties, sent by OPTIM SALON to the Client by email.

 

-       Image rights

During the Event, a photographer may document the Event and the photographs shall be used to promote future events.

At the time of registration, the Client is asked to grant OPTIM SALON its express authorisation, free of charge and as a commercial reference, to use photos and/or films depicting the Client and participating members, and to use these images freely on all media, particularly advertising media (including the Internet), in France and abroad and for a period of five years from the date of the Event, as part of the promotion of OPTIM SALON events and services.

The Client informs all its participants and guarantees OPTIM SALON that it holds all the rights and agreements necessary for this purpose. If the Client or any participant does not wish their image to be used, the Client shall inform OPTIM SALON, who shall take all necessary measures. OPTIMALON undertakes in any event never to harm the image of its Clients and participants, and the data subjects may consequently at any time refuse, in whole or in part, any such use or transfer.

3.4 In any event, and in general, OPTIM SALON may process Personal Data of the following nature:

        o   Connection data when the user accesses and uses the Site;

o   Correspondence data with OPTIM SALON;

o   Cookies and trackers;

o   Banking and transaction data. 

3.5 It is further specified that certain data and information are collected through the interactivity that may be established between the Client or user and OPTIM SALON:

        o   Follow-up and management of registration and participation in the Event;

o   Statistics ;

4.     Origin and purpose of the Personal Data collected

4.1 The Personal Data of Clients, participants and users of the Site and of the third-party registration platform of OPTIM SALON's supplier is collected directly and solely from them.

OPTIM SALON undertakes to obtain the express consent of the data subjects and to allow them to oppose the use of their Personal Data for any other purpose, as soon as this is necessary.

In all cases, Clients, participants, prospects and all users and data subjects are informed of the purposes for which their Personal Data is collected via the various data collection forms provided and necessary for their registration and participation in the Events.

It should also be noted that the Personal Data of participants may be communicated by the Client to OPTIM SALON, within the framework of the Client's rights and authorisations, it being noted that OPTIM SALON is not a party to the relationship between the Client and the participant.

 

4.2 In any event, it is reminded that the Personal Data collected is necessary for the proper performance of OPTIM SALON's services and to enable it to comply with its legal obligations.

The main purpose of collecting, storing and processing this information and Personal Data is:  

-       registration, organisation and supply of Services;

-       access to and use of the Site by the user;

-       management of the operation and optimisation of the Site;

-       prevention and detection of fraud, malicious software and management of security incidents;

-       management of any disputes.

5.     Sharing of Personal Data 

5.1 OPTIM SALON undertakes not to commercialize the Personal Data collected from the data subjects.

 

5.2 Personal Data may be shared with third parties in the following cases:

 

o   Personal Data may be communicated, in compliance with the laws applicable to OPTIM SALON, for one or more of the purposes described in Article 4.2 hereof, to the persons listed below:

o   OPTIM SALON's authorised personnel who may be required to process Personal Data;

o   OPTIM SALON's IT service providers, who are responsible in particular for providing a service relating to the Site;

o   When OPTIM SALON uses the services of service providers for a service relating to the Site, registrations and, more generally, Services. These service providers have limited access to the data of Clients and data subjects, within the framework of the performance of their services, and have a contractual obligation to use them in compliance with the provisions of the applicable regulations on the protection of personal data;

o   To authorized administrative or judicial authorities. It is reminded that if required by law, OPTIM SALON may transmit data in order to follow up on claims submitted and to comply with administrative and legal procedures.

 It is also specified that the information provided by the Clients and the data subjects is stored in a secure manner and shall be shared with the other Clients and participants in the Event, for the purposes of the Event and the proper provision of the Services. Clients are informed of the information shared with other participants, and which they have provided to OPTIM SALON for the purposes of holding the Event.

5.3 OPTIM SALON stores the Personal Data of the data subjects in the territory of the European Union.

However, in the event that OPTIM SALON's partners and service providers are located outside the European Union, the Personal Data thus collected may be transferred to countries outside the European Union, whose legislation on the protection of personal data differs from that of the European Union, it being specified that, in the event that the recipient country or countries do not ensure a level of data protection equivalent to that of the European Union, OPTIM SALON undertakes to take all appropriate guarantees, either on the basis of an adequacy decision or, in the absence of such a decision, on the basis of appropriate guarantees and conclusions with the said subcontractors, OPTIM SALON undertakes to take all appropriate guarantees, either on the basis of an adequacy decision or, in the absence of such a decision, on the basis of appropriate guarantees, and to conclude specific contracts with the said sub-contractors and partners to govern and secure the transfer of Clients' Personal Data, in particular on the basis of the standard contractual clauses adopted, a copy of which may be requested from the contact details below.

6.      Duration of Data retention

OPTIM SALON retains the Personal Data of the data subjects for the time strictly necessary for the purposes pursued, and in particular for the provision of its Services, in accordance with legal and regulatory requirements.

In any event, OPTIM SALON shall delete the said Personal Data on first request.

The Data is kept for three (3) years from the last contact with OPTIM SALON (registration to an Event, browsing of the Site, filling of a form on the Site, etc.).

This information may also be kept for a further period of two (2) years, with restricted and exceptional access, for the purposes of proof in compliance with OPTIM SALON's legal and regulatory obligations.

Accounting documents and records are kept for ten (10) years as accounting evidence.

 

7.     Legal basis for processing Personal Data

OPTIM SALON collects and uses the Personal Data of users, Clients, participants and all data subjects if this processing meets at least one of the bases below:

-     In accordance with the applicable Terms and the Contracts binding OPTIM SALON and the Clients and the supply of OPTIM SALON's Services accordingly;

-    By respecting the consent of Clients and data subjects, which may be revoked at any time;

-    To the extent necessary to meet its legal obligations; and

-     To the extent necessary to pursue its legitimate interests (or those of others), unless such interests are overridden by the interests or fundamental rights and freedoms of Clients or any data subject requiring the protection of their Personal Data.

 

It is reminded that:

-    only Personal Data relevant to the purposes listed above are collected;

-    consequently, if their Data is not collected, the Client or the person concerned participating shall not be able to register and take part in an OPTIM SALON Event;

-    the request to supply Data is contractual in nature;

- the Data is not used to make an automated decision within the meaning of the Regulations in force. 

8.      Rights of data subjects

Pursuant to the Applicable Regulations, data subjects are reminded that they have the following rights:

-       Right of access, including the right to obtain copies of all their Personal Data, as well as the essential details of how the Personal Data is processed;

-    Right to have their Personal Data rectified as soon as possible and to have any incomplete, inaccurate, ambiguous or outdated Personal Data completed;

-     Right to have their Personal Data erased if processing is no longer necessary, or if the data subject has withdrawn his or her consent or objected to the processing; or if the collection, use, disclosure or storage of the Personal Data is prohibited;

-         Right to limit the processing of Personal Data;

OPTIM SALON implements all technical and organisational measures to ensure the security of personal data processing and the confidentiality of Personal Data. Persons working for OPTIM SALON are required to respect the confidentiality of the Personal Data of the data subjects.
